"We / us" Means SKY EXPERTS LTD” , whose registered office is at 1B, Whitta Road, London, England, E12 5BX

"The Event" Means any holiday, accommodation, activity or function organised or advertised by us.

"You" Means the person who has signed the booking form and includes all the people on whose behalf you have signed.

"Supplier" Means the company or person that is holding or providing the event or any part of it.

"Price" Means the total cost of the event.

1. Terms and Conditions

These terms and conditions govern the contract between you and us to the exclusion of all other terms and conditions save for those implied by law, and no variation to these terms and conditions shall be valid unless in writing and signed by you and the company director.

2. Formation of Contract

No contract shall arise between you and us until we have received the deposit payable and we have sent to you written confirmation (This can be in the form of an email) of our acceptance of your booking.

3. Lead Name

The lead name on any booking with us accepts the full responsibility of collecting the full balance payable for the booking and indemnifies “Sky Experts” against any loss from any individual failing to pay within your group. The lead name of the group is also responsible for ensuring that all group members are aware they are bound by our terms and conditions. The lead name is also responsible for the completion of the online guest list on behalf of all persons on the booking. It is understood that those booking via email or telephone agree to, and accept our terms and conditions.

 4. Payment & Deposits

Deposits are payable at the time of booking and the balance of payments can be paid later as per the given deadline by suppliers as per the fare rules & conditions. Not all bookings can be booked on deposit, it depends upon the conditions of the airlines & routes specifically . For all deposit bookings fares are guranteed , however taxes cannot be guranteed & if there is any tax difference by the time you pay balance , it is always customer's responsibility to pay the same  & we will not be responsible for any tax change or any new tax being imposed before you fly & it has to be paid by customer & our company shall not be liable to pay the same 

Once booked on deposit, you cannot change the airlines, routing neither the passengers, only date change is permitted with applicable charges & within tickets conditions

An agreed deposit payable at the time of booking is always non-refundable non-transferable & anytime if you decide to cancel the booking all paid amounts & deposits are non-refundable & will be forfeited & cannot be adjusted or used to rebook again & no refunds are permitted.

The final balance is to be paid no less than 55 Days before the date upon which your event is due to start or as per the fare deadline provided at the time of booking. Failure to pay by this date will result in auto cancellation & paid deposit will be forfeited. In case of re-booking applicable difference in fare plus penalty of £25.00 per person as admin fee is payable as per current new availability.
If you do not make your deposit payments or balance payments by the agreed due date then you shall be deemed to have cancelled the event & total deposit paid towards those bookings gets forfeited & no refund or adjustments can be done further.

Deposits are used by us to enter into the contractual arrangements on your behalf and are non-refundable. Payments can be made with a valid Credit Card or Debit Card, online bank transfers or cheque(s) made payable to “Sky Experts Ltd.” where upon receipt we will endeavour to place the booking for you at the same price, although this cannot be guaranteed. We will however notify you should there be an increase in price.

If a promised cheque is not received or does not clear upon presentation we hold the right to cancel the reservation. Non-clearing or returned unpaid cheque will incur a £50.00 transaction charge. All Credit & Debit cards are subject to a 1.6% surcharge to the total cost of each transaction.

If you have a voucher from “Sky Experts Ltd” only one can be used per booking & can only be applied on selected flights or holiday as per its mentioned conditions & you have to provide voucher reference before the query.

5. Cancellation by Us

We may cancel the event or any part of it:
for safety reasons if we or our supplier(s) regard adverse weather conditions or other safety concerns as unacceptable and which cannot reasonably be overcome; If we reasonably believe that you may cause harm or damage to our reputation or to the reputation of our suppliers or to property belonging to our suppliers; If a supplier or suppliers are unable to host the event for any reason; If changes you wish to make to the booking mean it is uneconomical or impractical to hold the event. If we cancel the whole of the event we shall use our best endeavours to rearrange the event on a mutually convenient date, or provide a refund to you of the cost to us of the event. Save as above we shall be under no further liability to you for cancellation of the event or any part of it.

 6. Cancellation by You

For bookings on deposit: - You may cancel your booking same day before midnight, however in this case admin fee of £75.00 per person is applicable along with airlines or suppliers’ cancellation fee if any. Initial deposits paid less than £75.00 is non-refundable in case of cancellation if any & no refunds or adjustments can be done. All deposits and (if applicable) any additional payments made to date on the booking are non-refundable. All cancellations must be made in writing from the lead name on the booking. If you cancel after same day of booking then the cancellation fee is 100% of the total cost of the booking. Our admin fee on cancellations & refunds is £75.00 per person.In the event of partial cancellation or cancellation of one person or more out of the group, cancellation fee will be applicable for the specific person & will be charged per person accordingly from the deposit paid towards your event or booking.

For bookings without deposit: - You may cancel the booking same day before midnight, however in this case depending upon the cancellation fee of given airlines & supplier fee is payable along with our admin fee of £75.00.For all cancellations after same day is always 100 % non-refundable

Please note for any refunds it could take upto 7-8 weeks & once we receive refund from airlines /supplier , only after that same will be process to you  . Under no conditions same day or instant refunds are possible  .Refunds can only be processed to the same mode of payment , either same card or same bank account you paid with . To process your refund we may ask you to fill refund form for security reason & that is mandatory if required .

7. Change conditions:

If, due to any reason if you wish to change your reservations after its being confirmed & booked, applicable charges are applicable. In some of the case conditions could be non-changeable in that case no changes or no refunds could be possible. Please note while making changes to existing booking as per fare rule you have to select same fare class or higher fare class & fare difference is payable, no lower class or lower fare can be selected. In case of selecting low fare, no refunds will be done or no credit will be offered.

8. Failure to Provide an Event

If, due to reasons beyond our control, an event is unable to take place due to (but without limitation); closure of premises, the ceases of trading, a change in supplier management, weather restrictions, we will provide you and your group with an alternative event and if this is does not prove possible, a refund to you of the cost to us of the event.

9. Accommodation

If your booking includes accommodation, the named accommodation will remain confidential to “Sky Experts Ltd” and only be disclosed to you upon receipt of the completed secondary deposit and written confirmation from the supplier.

10. Meals

Breakfast is not included with accommodation bookings unless otherwise stated. The type of breakfast you will receive will be confirmed upon arrival at your accommodation (this may be hot or cold regardless of your quotation). Restaurant meals may require a pre-order to be completed by the lead name of the group. This should be completed and returned to us, or the venue as required. If a pre-order has not been completed, we accept no liability for meals not provided or delays in providing the meals for you. You will not automatically be sent any menus and menus may be of limited choice from a set-menu for groups. We will endeavour to meet any specialist dietary requests for any member of your group, but cannot guarantee these requests. We accept no liability if our suppliers are unable to meet these requests in advance, or once at the venue. If your group arrives late then we accept no liability.

11. Alterations + Surcharges Applied By Us

If due to circumstances beyond our control it becomes necessary to substitute an alternative supplier, or make any other alterations to the event (including accommodation) we shall inform you of the changes as soon as possible. You must pay any additional cost due to such changes. If the changes are, in the view of “Sky Experts Ltd” so substantial as to materially alter the event and you are unwilling to accept them then you may cancel the event and we will give a refund of the cost of the event to us. Surcharges may be applicable where an event requires a minimum number of participants to proceed, and the group does not meet this minimum number. This could lead to the cancellation of the event of which we are not held responsible and alternatives may be offered of an equal or greater value. If this value is greater, then you must pay us the difference in price. If the final number of a group is an odd number, then a single supplement surcharge will apply if the booking or an event (including accommodation) which is number dependent.

12. Alterations made by You

We shall try to accommodate any reasonable changes you wish to make to the event. Alterations and amendment requests should be made with us and not end suppliers and should be made in writing to us by the lead name. These changes shall not be deemed accepted until we have confirmed in writing to you. If you wish to increase or decrease the number of persons participating in the event you may do this up to six weeks prior to the date upon which your event is due to start. Amendments after that date will incur our administration charge of £55.00 per person. Changes such as arrival / departure dates and destination changes will also be subject to our administration charges plus applicable fees & fare difference by airlines or suppliers as per new availability. We cannot guarantee that the change to the price will be pro-rata, but will depend upon the arrangements we are able to make with our suppliers. 

13. Your Obligations

You shall at all times behave in a safe, responsible and courteous manner; comply with all instructions; regulations and codes of practice issued by us or our suppliers; ensure that you comply with all age restrictions imposed by our suppliers; ensure that you comply with all arrival times, and dress appropriately for the event. If you breach these obligations we may cancel or curtail the event or any part of it and in those circumstances, you shall not be entitled to any refund. You shall take out insurance suitable for your needs (including delays for events involving travel by land, sea, or air) before the event.

14. Our Obligations

We shall take reasonable care and skill in arranging the event and comply with all applicable laws in relation to the event; where ever possible, re-schedule the event instead of cancelling or offer a refund to you of the cost to us of the event. All of the photographs and illustrations we use on our website and in literature (including quotations) we send you are for marketing purposes and may not entirely represent the actual products received.

 15. Customer Feedback

If you have a problem whilst on your booking then you must contact the appropriate person(s) at the earliest opportunity, for example accommodation / restaurant manager. Unless there is a valid reason why you did not report your problem to the appropriate person(s), we will not consider ourselves liable for those complaints. If they are unable to resolve matters to your satisfaction then you must write to us within 7 days of the conclusion of the event. No complaint will be accepted outside of this time frame thus deeming you fully satisfied with all aspects of the event and the services we have provided to you. We will acknowledge any correspondence within 72 hours and endeavour to deal with the complaint as quickly as possible.

16. Bookings made by telephone:

If you make a booking by telephone, you must provide us with all information which we require. You must also ensure that all information which you provide is accurate and that the credit or debit card you are using is your own & is UK registered or, subject to our agreement, if it is a third party's you have their express authorization to use their credit or debit card and that sufficient funds are available to cover the cost of the arrangements which you book with us. We only accept UK credit & debit cards, no overseas cards are accepted for any payments towards your flights. If you are paying with third party card which is not registered under traveller’s name, we can request you to fill & sign third party authorisation form for security reasons & tickets will be issued once the same form is received . If we accept your booking, we shall debit payment from you and send you a confirmation. From this point cancellation charges will apply: Please note the details of phone booking always confirmed in writing to avoid any mistake. As soon as you receive the confirmation request, please check the details carefully and inform us immediately if anything appears to be incorrect as it may not be possible to make changes later. Once you have confirmed these details, we will proceed to confirm the booking with the supplier/s.

Further, in an effort to minimise the effects of credit card fraud, we reserve the right to carry out random checks, including checks of the electoral roll, and may request you to either fax or email to us proof of your address and a copy of the credit/ debit card and recent statement, or a copy of the cardholder's and/or passenger's passport/s, before issuing any tickets. We reserve the right to insist that travel documents be sent to the billing address of the card used to pay for the booking. Sky Expert Ltd. reserve the right to pass on any charges relating to card chargebacks. As a British company it is not always possible for us to successfully complete the necessary security and identity checks on cards which are registered to billing addresses outside the United Kingdom. If you make a booking using a credit card registered outside the UK, we reserve the right to reject your booking if we are unable to satisfactorily complete the relevant checks.

17. Managing your booking:

Please ensure that all your travel, passport, visa and insurance documents are in order and that you arrive in plenty of time for checking in at the airport. It may be necessary to reconfirm your flight with the airline prior to departure. Please ask us for details at least 72 hours before your outbound flight. You should take a note of any reference number or contact name when reconfirming. If you fail to reconfirm you may be refused permission to board the aircraft and you are unlikely to receive any refund.

Additionally, please make sure to check with your airline/train operator/hotel directly before your trip, in case they have any specific guidelines to follow.

Do not travel if you or your associate travellers feel unwell. The transportation companies such as Airline(s) / Hotel(s) / Airport(s) / Vehicle Transportation may be screening for infection(s) and may refuse you travel at origin, or not allow you to enter at transit or destination.

Please note that your passport should be valid for 6 months from the date of your return flight to the United Kingdom. When traveling to USA please ensure you have a machine readable passport and a valid visa (ESTA) to enter/travel, otherwise you will be refused entry.

We recommend to visit   https://www.gov.uk/foreign-travel-advice for the latest travel advice and entry requirements. Its your responsibility to make sure you fullfill all required procedures before & after your travel, neither Sky Expert Ltd. nor its associate will be responsible for cancellation and refund of passenger’s trip if he/she fails to provide necessary documents at the time of traveling and denied to board the flight or enter in the country.

18. Special Requests:

We are happy to forward details of any additional requirements you may have (for example seating or diet preferences, assistance, etc.) to the relevant travel supplier. These are treated as special requests, and as such fulfilment of these requests cannot be guaranteed.

19. Pregnancy:

If you will be traveling while pregnant, please note that regulations apply to the carriage of passengers who are more than a certain number of weeks pregnant at the time of travel. These regulations vary between airlines, so it is your responsibility to check the airline's policy before making a booking.

In some cases travel may not be permitted, or you may be required to travel with a doctor's letter, or even obtain a medical clearance from the airline.
You must ensure that your travel insurance covers you if you are pregnant. We recommend that you also confirm with your doctor before booking that you are fit to travel.

20. Travelling with Child

We need date of birth for children at the time of booking & same will be forwarded to airlines. Airlines require original Date of Birth Certificate for child travelling to South Africa & some other destinations, so its your responsibility to carry all necessary documents while travelling.

21. Travelling with Infants

Airlines require that infants must be of a minimum age (typically six weeks) before they will be permitted to travel. Please ensure that you are aware of the airline's policy before making a booking. Infants must sit on an adult's lap or occupy an infant seat – please contact the airline you are traveling with for details of appropriate seats. All special requests regards to bassinets, meals request & other additional request are subjects to availability & is not guaranteed .To qualify for an infant fare, the infant must generally be under two years old on the date of return travel. Children aged two years or above must occupy a seat.

22. Contracts (Rights of Third Parties) Act 1999

No part of this agreement shall confer on any third party any benefit or right to enforce any terms of this agreement.

23. DATA PROTECTION ACT 1998

By making a reservation with us you agree to the use and disclosure of the information you provide for the following purposes: to enable us to process your booking (when it may be transferred abroad), if you purchase insurance we may process your information (including medical information) about you or your travelling party and pass it to insurers; for market research and analysis purposes; to avoid fraud and to enable us to contact you by letter, telephone or e-mail, SMS or any other technology we feel appropriate, with details of our products or those of our suppliers. If you pay by Credit Card, then we may disclose your payment and booking details (including those of your travelling parties) to other companies who require these details in order to process your payment, and / or if the company that issued your card fails to settle your payment or requires a subsequent repayment. Calls may be recorded for training and quality purposes. If you book via our website, or if you have chosen for us to contact you via e-mail, we will communicate with you using the email address you have provided to supply you with your travel documentation. We will assume that your email address is correct and that you understand the risks associated with using this form of communication. You must inform us immediately of any changes to your method of communication. Please note that you may still need to contact us via our call centre or in writing as required in our Terms and Conditions.

24. Your Financial Protection

SKY EXPERTS LTD. acts retail agents for ATOL Protected agencies governed by the Civil Aviation Authority as well as for IATA & ABTA protected companies.This means that all bookings made with Sky Experts Ltd. are financially protected under the relevant supplier protection bonds. These securities are mainly extended to customers who are based and book and pay in the United Kingdom. For your security and convenience, all tickets and reference numbers are issued and supplied instantly to our clients. For specific booking conditions, please speak to your dedicated consultant as rules can differ for various parts of your itineraries.

We, or the suppliers identified on your ATOL Certificate, will provide you with the services listed on the ATOL Certificate (or a suitable alternative). In some cases, where neither we nor the supplier are able to do so for reasons of insolvency, an alternative ATOL holder may provide you with the services you have bought or a suitable alternative (at no extra cost to you). You agree to accept that in those circumstances the alternative ATOL holder will perform those obligations and you agree to pay any money outstanding to be paid by you under your contract to that alternative ATOL holder. However, you also agree that in some cases it will not be possible to appoint an alternative ATOL holder, in which case you will be entitled to make a claim under the ATOL scheme (or your credit card issuer where applicable).

If we, or the suppliers identified on your ATOL certificate, are unable to provide the services listed (or a suitable alternative, through an alternative ATOL holder or otherwise) for reasons of insolvency, the Trustees of the Air Travel Trust may make a payment to (or confer a benefit on) you under the ATOL scheme. You agree that in return for such a payment or benefit you assign absolutely to those Trustees any claims which you have or may have arising out of or relating to the non-provision of the services, including any claim against us, the travel agent (or your credit card issuer where applicable). You also agree that any such claims may be re-assigned to another body, if that other body has paid sums you have claimed under the ATOL scheme.

25. Jurisdiction

This agreement shall be construed in accordance with the laws of England and Wales and the courts of England and Wales shall have exclusive jurisdiction to deal with any disputes arising between you and us or our suppliers.
 

26. Changes to these Terms and Conditions

We may need to make changes to these terms and conditions. Any changes can only be made by us and not any third party member. We reserve the right to amend or improve these terms and conditions without prior notification. When it is necessary for changes to be made, we will forward you a copy of these changes and all reservations will abide by the amended terms, with the exception of reservations already made.
